Zarah Sultana has taken control of a company holding £800,000 in “Your Party” donations after a major funding row, raising fresh questions about party financing

According to Sky News, she promised co-leader Jeremy Corbyn that the funds would be distributed to the entire party.

But that hasn't happened yet, which has frustrated certain Your Party leaders who have been attempting to access the funds for weeks. One source called the situation "an insane mess."

Former South African politician Andrew Feinstein, former Labour MP Beth Winter, and former Labour mayor Jamie Driscoll were the previous caretakers of the gifts, and there has been a significant dispute behind the scenes.

The three served as directors of MoU Operations, a business established in April to assist a separate group of MPs led by Mr. Corbyn, a former Labour leader.

According to Sky News, your party filed with the electoral commission on September 30 and stated £850,000 in assets. However, despite multiple demands from senior figures to the MoU, no money was transferred.

This week, the dispute escalated to the point that Your Party insiders stated they were thinking about filing a lawsuit. According to Sky News, before the three directors finally broke their silence and resigned on Wednesday night, attorneys had written a "letter before action" to send to the MoU, informing them of the judicial proceedings.

She asked supporters to become paying members for £5 per month or £55 per year in an email she sent them on September 18, which Mr. Corbyn claimed was not authorized. Although it appeared identical, the website's domain name was distinct from Your Party's, and it stated that MoU was in charge of running it and collecting the membership money.

However, Mr. Corbyn's Peace and Justice Project was in charge of managing the data of the recipients of the email, and neither MoU nor Ms. Sultana owned it. The Information Commissioner's Office received the referral.

Since those who paid are entitled to a refund, it is not anticipated that the money received by MoU in membership fees will be transferred to Your Party.

What legal risks could arise from Sultana controlling MOU Operations?

As a controlling figure, Sultana could be at threat of violating fiduciary duties if she doesn't act in the stylish interests of the company and its stakeholders, particularly regarding the operation and use of the finances. Given the internal conflicts within Your Party, there could be controversies over who authentically controls the finances and decision- making processes. This threat increases if opposing coalitions challenge her authority in court. 

Still, Sultana could face civil liability or nonsupervisory action, especially if benefactors or members purport misconduct or breach of trust, If mishandling or misappropriation of the donations occurs.However, Sultana's control could come under legal scrutiny, If any misrepresentation regarding the use of finances or the nature of the association is uncovered. 

Non-compliance with applicable company laws and regulations girding political donations and data operation could lead to penalties and legal action.
